1. Program description
KISO provides SMS and MMS messaging used for customer relationship management, lead response, appointment scheduling and reminders, service updates, support, account notices, requested information, and—where separately authorized—promotional communications. Messages may be sent by KISO for its own business or by KISO on behalf of a business using the KISO platform (a "KISO Customer"). The business identified in the message is the sender of that messaging program.
2. Consent to receive text messages
When you provide your mobile number and affirmatively opt in, you authorize the identified sender and KISO, as its technology provider, to send text messages to that number. Messages may be sent using an automatic telephone dialing system or other automated technology. Your consent applies only to the program and sender disclosed when you opt in.
Consent to receive marketing texts is not a condition of purchasing any property, goods, or services. You represent that you are the subscriber or customary user of the number provided and are authorized to consent. If your number changes or is reassigned, you agree to opt out or notify the sender before giving up the number.
3. Message frequency and charges
Message frequency varies based on your interactions, requested services, appointments, account activity, and the specific program. Recurring messages may be sent. Message and data rates may apply. KISO and KISO Customers do not charge you for text messages, but your wireless carrier's rates and terms apply. Contact your carrier with questions about your text or data plan.
4. How to opt out
You can cancel a messaging program at any time by replying STOP to the number that sent the message. You may also use another legally recognized opt-out phrase. We may send one final message confirming your opt-out. After that confirmation, you should no longer receive messages from that program unless you later opt in again.
An opt-out applies to the specific sender and messaging program associated with that number. If you participate in multiple programs, you may need to opt out of each separately. Transactional or non-marketing messages that are legally permitted may continue through another channel or program.
5. Help and support
Reply HELP to the number that sent the message for program information and support instructions. You may also contact the business identified in the message. For KISO platform support, email api@kisohq.com. Include the sending number and a description of the issue, but do not send passwords or sensitive information.
6. Delivery, eligibility, and carriers
Text messaging may not be available on every device, carrier, or in every location. Delivery is subject to effective transmission by your wireless carrier and communications providers. KISO, KISO Customers, and carriers are not liable for delayed or undelivered messages to the extent permitted by law. Supported carriers and sending numbers may change without notice.
You must have a text-enabled mobile device and an active account with a participating carrier. We may suspend or terminate a messaging program, change its sending number, or modify its content or frequency at any time.
7. Privacy and mobile information
We use mobile numbers, consent records, message content, delivery data, and related information to provide and support the messaging program, process opt-outs, prevent abuse, comply with law, and as otherwise described in our Privacy Policy or the identified KISO Customer's privacy notice.
Mobile opt-in information and SMS consent will not be sold or shared with third parties for their own marketing or promotional purposes. We may share information with carriers, communications providers, vendors, and the identified KISO Customer as needed to deliver messages, operate the program, and comply with law.
8. Messages sent for KISO Customers
When a KISO Customer sends you messages through KISO, that customer determines the message purpose, recipients, content, and timing and is responsible for its program, consent, and legal compliance. KISO processes messaging data as a service provider to that customer. Questions about the underlying relationship, appointment, transaction, offer, or the customer's privacy practices should be directed to the customer identified in the message.
9. Changes and contact
We may update these SMS Terms by posting a revised version and changing the date above. Changes take effect when posted unless a later date is stated. Your continued participation after the effective date constitutes acceptance to the extent permitted by law.
